1. About us and these terms

This store is operated by Fitera Sport ("we", "us", "our"), an online retailer of sports and fitness equipment and apparel selling to customers in the United States. You can reach us at any time at support@fiterasport.store.

2. Using our website

You may browse and buy from the site for your own personal, non-commercial use. You agree not to:

• use the site for any unlawful or fraudulent purpose;
• attempt to gain unauthorized access to the site, its servers or other users' accounts;
• introduce viruses or other harmful code, or interfere with the site's operation;
• copy, scrape or republish our content, images or product descriptions without permission;
• place orders using false details or someone else's payment method.

We may suspend or refuse service to anyone who breaches these terms.

3. Products, images and descriptions

We describe our products as accurately as we can. Product photographs are for illustration; colors can appear differently on different screens, and packaging may vary. Where a product has size, color or weight options, the option you select at checkout is what we ship. If a product you receive is materially different from its description, contact us and we will make it right.

All products are subject to availability. Stock figures update automatically, but very occasionally an item sells out between your order and shipment.

4. Prices and payment

• All prices are shown in U.S. dollars (USD).
• Shipping is free on every order, with no minimum. Sales tax, where applicable, is calculated and shown at checkout before you pay.
• Payment is taken at the time you place your order, through our secure checkout.
• We accept the payment methods displayed at checkout.

Prices may change at any time, but changes never affect an order we have already accepted.

5. How a contract is formed

1. You place an order through the checkout. This is an offer to buy, not yet an accepted contract.
2. We send you an order acknowledgement by email confirming we have received it.
3. A contract is formed when we send you a shipping confirmation. Until then, we may decline the order.

7. Shipping

We ship orders within 1 business day and delivery normally takes 5–10 business days, fully tracked and free of charge. Full details, including what happens if a package is delayed or lost, are in our Shipping Policy, which forms part of these terms.

Risk in the goods passes to you when they are delivered to the address you gave us.

8. Cancellation, returns and refunds

You can return most items within 30 days of delivery for a full refund. How to return an item, what condition it must be in, and how quickly you are refunded are all set out in our Return & Refund Policy, which forms part of these terms.

9. Defective goods and our guarantee

Goods must be as described, fit for their purpose and of satisfactory quality. If they are not, you may be entitled to a repair, replacement or refund under applicable consumer protection law. In addition, we provide a 12-month guarantee covering defects that arise from normal training use. The guarantee does not cover general wear and tear, accidental damage, or misuse. Our guarantee sits alongside your legal rights and does not replace them.

10. Our liability

We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care. We are not liable for loss or damage that is not foreseeable, or for business losses such as loss of profit, business or opportunity.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

11. Product use and safety

Fitness equipment must be used sensibly and as intended. Check the product and any instructions before use, inspect equipment for wear, and stop if something feels wrong. If you have a medical condition or are unsure whether an activity suits you, speak to a doctor or qualified trainer first. Products intended for children should only be used under adult supervision.

12. Intellectual property

The Fitera Sport name, logo, site design, text and images are owned by us or licensed to us and are protected by intellectual property law. You may not reproduce them commercially without our written permission.

13. Accounts

If you create an account, keep your password confidential and let us know promptly if you think someone else has used it. You are responsible for activity carried out through your account.

14. Events outside our control

We are not liable for delays or failures caused by events beyond our reasonable control, such as extreme weather, strikes, carrier failures or interruptions to power or telecommunications. If such an event occurs we will contact you and, where the delay is substantial, you may cancel and receive a full refund.

15. Complaints

If something has gone wrong, email support@fiterasport.store with your order number. We aim to acknowledge complaints within one business day and resolve them within five.

16. Changes to these terms

We may update these terms from time to time. The version published when you place your order is the version that applies to that order.

17. Governing law

These terms are governed by the laws of England and Wales, where Fitera Sport is established. Nothing in this section deprives you of the protection afforded by the mandatory consumer protection laws of the U.S. state in which you live, and you may bring proceedings in your local courts.
